New York, NY – July 30, 2024 – In a challenge brought by AT&T Services, Inc., BBB National Programs’ National Advertising Division determined that Comcast Cable Communications Management, LLC, provided a reasonable basis for the claims that Xfinity Internet is fast, reliable, and “powerful.”
The challenged claims appeared in two commercials for Comcast’s Xfinity Internet service – one featuring NFL star Christian McCaffrey and the other featuring basketball star Caitlin Clark.
The National Advertising Division (NAD) determined that the commercials do not reasonably convey the comparative superiority message alleged by AT&T, that Xfinity Internet is faster, more reliable, and more “powerful” than its competitors.
NAD determined that there is no performance comparison in the commercials, but merely the general statement that “not all internet providers are the same.” Thus, the message reasonably conveyed by the commercials is that Xfinity Internet is fast, reliable, and “powerful,” and that consumers should consider those attributes when purchasing a service, as these attributes may vary depending on the provider.
In its advertiser statement, Comcast stated that it “appreciates NAD’s determination that the commercials are humorous ads that highlight truthful claims about Xfinity Internet service that do not convey a superiority message against all competing services.

National Advertising Division Finds Certain Claims for Shark Detect Pro Supported; Recommends SharkNinja Modify or Discontinue Others
New York, NY – July 29, 2024 – In a challenge brought by competitor Dyson, Inc., BBB National Programs’ National Advertising Division determined that SharkNinja Operating Company LLC provided a reasonable basis for its claim that the Shark Cordless Detect Pro Auto-Empty System base “holds dirt and debris for up to 30 days.”
NAD further determined that SharkNinja provided a reasonable basis for its modified claims that:
- The Detect Pro is “30% Lighter than the Shark Vertex Pro.”
- The Detect Pro’s auto-empty feature has “1000x less dust exposure” compared with the manual emptying of a Shark full sized vacuum (model NV130).
However, the National Advertising Division (NAD) recommended that SharkNinja discontinue or modify certain “50% better dirt pick up” claims and comparative cleaning claims vs. other Shark vacuums.
50% Better Pick Up Claims
The National Advertising Division (NAD) found that SharkNinja’s “up to 50% better dirt pickup” claim reasonably conveys a comparative superiority message that the Detect Pro achieves up to 50% better dirt pickup than other competing vacuums.
In the absence of evidence supporting the comparative superiority claim, NAD recommended that SharkNinja discontinue the claim or modify it to make clear that the Detect Pro achieves 50% better dirt pickup when comparing it with the vacuum’s own Boost Mode with Eco Mode.
NAD further recommended that SharkNinja discontinue its claim that the Detect Pro provides 50% better pickup than the Shark Cordless Stratos.
30% Lighter Claims
Dyson challenged several variations of SharkNinja’s claims that the Detect Pro is “30% lighter with the performance of a full-sized cordless.” During the proceeding, SharkNinja agreed to permanently modify future advertising to state that the Detect Pro is “30% lighter than the Shark Vertex Pro” and that the Detect Pro cleans “like a full-sized Shark cordless stick.”
The National Advertising Division (NAD) concluded that SharkNinja provided a reasonable basis to support its claim that the Detect Pro is “30% Lighter than the Shark Vertex Pro.”
However, NAD recommended that SharkNinja modify its claim that the Detect Pro cleans “like a full-sized Shark cordless stick” to clearly and conspicuously disclose the specific “full-sized Shark cordless stick” to which the Detect Pro is compared and the basis of the comparison (i.e., compared in Boost mode based on ASTM F608).
Further, NAD determined that the claim “Take on any spot in your home with full-sized* cordless power in a 30% lighter** frame” conveys the unsupported message that the object of the comparison for both weight and performance is the same vacuum. Therefore, NAD recommended that SharkNinja modify its advertising to avoid conveying that the weight and performance claims compare the Detect Pro to the weight and performance of a single vacuum.
30 Days Claims
The National Advertising Division (NAD) determined that the combined results of two debris studies performed to assess the types and quantity of debris that are commonly vacuumed in homes across the U.S. using cordless vacuums provided a reasonable basis for SharkNinja’s claims that Detect Pro Auto-Empty System “holds dirt and debris for up to 30 days.”
Given the variety of households tested and percentage of testers that collected an amount of debris that the Detect Pro base could contain, NAD found that a high percentage of consumers achieve the maximum “up to 30-day” benefit and found the claim to be reasonably supported.
1000x Claims
Dyson challenged several variations of SharkNinja claims that its Detect Pro Auto-Empty System offers “up to 1000x less dust exposure,” accompanied by the disclosure that the comparison is “based on third-party plume testing while emptying vs. manual empty.” During the proceeding, SharkNinja agreed to permanently modify future advertising so that comparisons will identify that the comparison is based on third-party plume testing versus manual emptying of the Shark NV130.
The National Advertising Division (NAD) concluded that SharkNinja’s evidence provided a reasonable basis for the claim that auto-emptying the Detect Pro vacuum causes up to 1000x less dust exposure compared to manually emptying the Shark NV130.
In its advertiser statement, SharkNinja stated that it will comply with NAD’s decision and take NAD’s recommendations into consideration in developing future advertising.

National Advertising Division Recommends Dr. Luke Healthcare Discontinue Treatment Claims for its Fungal Nail Renewal Product
New York, NY – July 24, 2024 – In a challenge brought by Advantice Health, BBB National Programs’ National Advertising Division recommended that Dr. Luke Healthcare discontinue certain claims for Dr. Luke’s Fungal Nail Renewal product, including health-related claims that the product treats nail fungus, natural claims, and claims that a doctor recommends the product or that it treats a medical condition.
The challenged claims, which appeared on various channels including Amazon, Walmart, and Dr. Luke’s website, position Fungal Nail Renewal as an effective treatment for nail fungus (onychomycosis).
Treatment Claims
The National Advertising Division (NAD) determined that Dr. Luke’s claims that its product treats nail fungus are not supported by competent and reliable scientific evidence.
NAD determined that the studies on products with acetic acid were not a good fit for the challenged claims because the composition of the products tested, the dosage, and the mode of administration differed from the Dr. Luke product.
NAD also found that the Food and Drug Administration’s Over the Counter (OTC) monograph regarding 1% Tolnaftate does not support nail fungus treatment claims. Further, NAD concluded that the evidence provided by Dr. Luke regarding the efficacy of the Chinese herb ingredients and the benefit they provide did not support the challenged treatment claims.
NAD recommended that Dr. Luke discontinue the following claims:
- “Extra Strength Toenail Fungus Treatment for Toenail or Fingernail”
- “Repair Onychomycosis deeply”
- “Formulated to effectively treat Nail Damage. Nail Fungus. Based on Chinese Traditional Treatment Research”
- “Doctor Recommended”
- “Dr. Luke’s Toenail Fungus Treatment cures nail fungus”
- “Kills fungus, stops itching and burning, restores your skin and toe’s health”
- “Repair & Renew – It can radically repair damaged nails, such as nail discoloration, nail thickening, nail splitting, nail crumbling”
- “Extra strong formula, renew damaged nail faster “
- “It also protects from further damage”
Natural Claims
The National Advertising Division (NAD) determined that Dr. Luke’s “natural formula” claims reasonably convey the message that the product is formulated without artificial ingredients and treats nail fungus through natural ingredients. As the active ingredient in Fungal Nail Renewal is a synthetic compound, NAD found the natural claims to be unsupported and recommended they be discontinued.
Doctor Recommended/Treatment Claims
The National Advertising Division (NAD) found that Dr. Luke’s imagery of a man in a white coat with a stethoscope conveys the messages that a doctor recommends the product or that the product treats a medical condition. Although Dr. Luke voluntarily discontinued its doctor-recommended claims, in the absence of supporting evidence, NAD recommended that Dr. Luke modify its advertising to avoid conveying these messages.
During the proceeding, Dr. Luke permanently discontinued a number of claims. Therefore, NAD did not review these claims on their merits and will treat the claims, for compliance purposes, as though NAD recommended they be discontinued.
In its advertiser statement, Dr. Luke stated that although it disagrees with the decision, it will “comply with NAD’s recommendations.”

National Advertising Division Finds Flag Image on Kendamil Infant Formula Packaging Conveys Supported Message about Products’ Origin
New York, NY – July 17, 2024 – In a Fast-Track SWIFT challenge brought by competitor Mead Johnson & Company, LLC, BBB National Programs’ National Advertising Division determined that use of a flag image on product packaging for Kendal Nutricare’s Kendamil infant formula reasonably conveys a supported message about the products’ origin.
NAD, however, recommended Kendal modify claims to disclose the product’s country of origin in certain contexts.
Fast-Track SWIFT is an expedited process designed for single-issue advertising cases brought to the National Advertising Division (NAD).
Kendal manufactures certain Kendamil products in the United Kingdom (UK) from milk sourced from the UK and other European countries.
Mead Johnson argued that Kendal’s use of a blue circular logo with nine gold stars on packaging for Kendamil infant formula and on its website conveys the misleading message that products made in the UK are made in the European Union (EU).
NAD determined that Kendamil’s packaging reasonably conveys a supported message about the products’ origin. NAD noted that the flag logo appears in a context where the net impression is that products originate from the European continent as a whole, including the UK. Moreover, the UK is identified as the country of origin on the bottom of the packaging.
However, NAD noted that Kendal’s US website displays the nine-star blue flag image without a specific country of origin identified (just references to Europe generally). Accordingly, NAD recommended that if any specific products are referenced in conjunction with statements about the products’ geographic roots and the flag logo, Kendal should clearly and conspicuously disclose that product’s particular country of origin.
In its advertiser statement, Kendal stated that it is “grateful to the NAD for its determination that the use of the European Flag Icon on our infant formulas packaging is appropriate. We accept the NAD’s recommendation to provide further context when the European Flag Icon appears on the US website.”

AUSTIN, July 16, 2024 — The MICHELIN Guide has arrived in the Lone Star State, as Michelin and Travel Texas today revealed the MICHELIN Guide Texas.
Texas is home to award-winning barbecue, locally sourced seafood and steaks, and savory Tex-Mex to name a few. The state’s vibrant and mature gastronomic scene showcases culinary talents rooted in Texas culture and inspired by international cuisines both near and far.
“The Texas culinary scene has proven to be an exhilarating one, with multicultural influences, homegrown ingredients and talent that is rich in ambition,” said Gwendal Poullennec, International Director of the MICHELIN Guides. “Foodies and travel enthusiasts alike will find something to enjoy, with such a broad dining scene spanning farm-to-table dishes, fusion cuisine, upscale dining and the famous Texas-style barbecue. The first MICHELIN Guide Texas selection will be revealed later this year, and it will feature culinary gems in Austin, Dallas, Fort Worth, Houston and San Antonio.
The anonymous MICHELIN Guide Inspectors award the iconic MICHELIN Stars – one, two or three – to unparalleled cuisine. The Guide is also renowned for its Bib Gourmand selection, highlighting restaurants that offer great quality food at good prices. The MICHELIN Green Star is given to restaurants that are leaders in sustainable gastronomy. Recommended restaurants and special professional awards are also highlighted by the Inspectors.
The MICHELIN Guide’s anonymous Inspectors are already in the field, making dining reservations secretively and paying for all their meals to ensure they are treated the same as any other customer.

The 2024 Texas restaurant selection will join the MICHELIN Guide selection of hotels later this year and will feature the most unique and exciting places to stay in Texas and around the world. History and methodology
The upcoming Texas restaurant selection will follow Michelin’s historical methodology, based on five universal criteria, to ensure each destination’s selection equity: 1) quality products; 2) the harmony of flavors; 3) the mastery of cooking techniques; 4) the voice and personality of the chef as reflected in the cuisine; 5) consistency between each visit and throughout the menu (each restaurant is inspected several times a year).
The MICHELIN Guide remains a reliable companion for any traveler seeking a great meal. The Guide was first published in France at the turn of the 20th century to encourage tire sales by giving practical advice to French motorists. In National Advertising Division Case, GuruNanda Voluntarily Discontinues Claims Made through Influencers for Coconut Pulling Oil Products
New York, NY – July 16, 2024 – BBB National Programs’ National Advertising Division has closed a Fast-Track SWIFT challenge initiated by Oral Essentials, Inc. regarding claims that competitor GuruNanda’s coconut pulling oil products, Coconut + Mint Pulling Oil and Cocomint Pulling Oil with 7 Essential Oils, can “naturally reverse a cavity” and “reverse cavities.”
Oral Essentials produces and markets oral hygiene products under its Lumineux brand. GuruNanda makes personal and oral care products focusing on holistic care.
Fast-Track SWIFT is an expedited process designed for single-issue advertising cases brought to the National Advertising Division (NAD).
The challenged claims appeared in videos on influencers’ TikTok and Instagram accounts, with some reposted to GuruNanda’s official Instagram page.
GuruNanda informed NAD that it would permanently discontinue the challenged claims, including content made by affiliated influencers and content reposted to its own advertising and social media pages. Therefore, NAD did not review the claims on their merits and will treat the claims, for compliance purposes, as though NAD recommended they be discontinued.
In its advertiser statement, GuruNanda stated that it will comply with NAD’s decision and that it “did not authorize these claims,” however it is “committed to truthful advertising and will use every resource available to ensure that parties known to us, by any means, who are making these false statements about our products will cease making such claims.”
