National Advertising Review Board Recommends Molson Coors Discontinue “Light Beer Shouldn’t Taste Like Water” Claim in Two Advertisements

New York, NY – April 11, 2023 – A panel of the National Advertising Review Board (NARB), the appellate body of BBB National Programs, recommended that Molson Coors Beverage Company discontinue the claim that “light beer shouldn’t taste like water. It should taste like beer” in the context of two challenged advertisements promoting Miller Lite.

The advertising at issue, which appeared in two 15-second advertisements, had been challenged by Anheuser-Busch Companies, LLC. Following NAD’s decision (Case No. 7183), Molson Coors appealed NAD’s recommendation that it discontinue the claim that “light beer shouldn’t taste like water. It should taste like beer.”

In agreement with NAD, the NARB panel concluded that in the context in which the claim is used in the challenged ads, the ad slogan is not puffery but is a comparative claim requiring substantiation in the form of a well-conducted consumer taste test.

Further, the NARB panel found that Molson Coors did not provide substantiation for the claim, nor did it provide any consumer research regarding its argument that reasonable consumers would not take away a comparative claim. The NARB panel concluded that, in context, the compare-and-contrast visuals and voiceover placement of the slogan at issue likely communicates a comparative claim to at least a significant minority of reasonable consumers.

The NARB panel recommended that Molson Coors discontinue the claim that “light beer shouldn’t taste like water. It should taste like beer” in the context of two challenged advertisements, but noted that nothing in its decision precludes the advertiser from making claims relating to consumers’ taste preference or other claims pertaining to the taste qualities of its beer or competing beers as long as they are properly substantiated.

Molson Coors stated that it “supports the NAD and NARB self-regulatory process and will comply with the recommendation of the NARB,” although it “continues to disagree that the phrase ‘light beer shouldn’t taste like water. It should taste like beer’ is anything but puffery, even in this context.”

National Advertising Division Finds Certain WhatsApp Express Claims Supported; WhatsApp Appeals NAD Recommendation to Discontinue or Modify Unsupported Claims

 

New York, NY – October 12, 2022 CTIA represents the U.S. wireless communications industry, including carriers and equipment manufacturers. CITA members, which include AT&T, Verizon, T-Mobile, Nokia, Intel, Qualcomm, Ericsson, and others, challenged WhatsApp claims that appear in a television commercial titled “Doubt Delivered.”

The National Advertising Division (NAD) of BBB National Programs determined that WhatsApp, LLC provided a reasonable basis for express claims for its WhatsApp messaging service analogizing SMS text messages to “open mail” and that WhatsApp did not overstate the vulnerability of SMS text messages compared to end-to-end encrypted messaging.

However, NAD found WhatsApp communicated certain other implied messages that NAD recommended discontinued or modified to better reflect the evidence, including that wireless carriers are careless; that they read user’s personal text messages; and that “Consumers must switch to a specialized app like WhatsApp to protect their messages from pervasive eavesdropping.” WhatsApp will appeal these portions of NAD’s decision.

NAD has long recognized that although humor can be an effective and creative way for advertisers to highlight the differences between their products and those of their competitors, humor and hyperbole do not relieve an advertiser of the obligation to support messages that their advertisements might reasonably convey.

 At issue for NAD was whether the challenged commercial conveyed the misleading message that carriers and third parties routinely read private text messages and whether it disparages the practices, care, and ethics of wireless carriers.

 

Express Claims

NAD considered whether WhatsApp’s analogy between SMS text messages and “open mail” was supported or whether it overstated the vulnerability of SMS text messages to being compromised as compared with end-to-end encrypted messaging. After reviewing the evidence presented by WhatsApp, NAD concluded that it provided a reasonable basis for the advertiser’s “open mail” claims that:

  • “Text messages are just like open pieces of mail, they’re all open.”
  • “Every text message that individuals send is just as open as opened letters.”

 

Implied Claims

NAD considered whether the challenged commercial conveyed implied claims that improperly disparaged wireless carriers and that consumers must switch to WhatsApp to protect their messages from pervasive eavesdropping. NAD determined that the challenged commercial conveyed the implied messages that:

  • Wireless carriers, routinely and without consequences, read user’s personal text messages; and
  • Consumers must switch to a specialized app like WhatsApp to protect their messages from pervasive eavesdropping.

 

In so finding, NAD noted that “Doubt Delivered” goes beyond merely highlighting the differences between the advertiser’s product and that of its competitors but instead takes aim at the quality of competing messaging services and at the practices of the providers themselves. NAD found that the overarching takeaway of the commercial is one of casual and persistent snooping on the recipient’s mail – a message that comes through despite – and perhaps even because of – the commercial’s use of humor and hyperbole.

Further, NAD concluded that the commercial conveys the disparaging message that wireless carriers are careless with their customer’s communications.

Because the advertiser did not provide a reasonable basis for these implied claims, NAD recommended that they be discontinued or modified to better reflect the evidence.

NAD found that “Doubt Delivered” did not reasonably convey the challenged implied claims that:

  • All messages will be read by wireless carriers.
  • The content of text messages is collected by wireless carriers for their own purposes.
  • Wireless carriers are dishonest.

 

In its advertiser statement, WhatsApp stated that it “respectfully disagrees with NAD’s conclusions with respect to certain of the alleged implied claims and will appeal those portions of NAD’s decision.”

Direct Selling Self-Regulatory Council Refers Fifth Avenue Collection Earnings Claims to the Federal Trade Commission for Possible Enforcement Action

McLean, VA – October 5, 2022The Direct Selling Self-Regulatory Council (DSSRC) of BBB National Programs referred certain Fifth Avenue Collection, Inc. earnings claims to the Federal Trade Commission (FTC) for possible enforcement action after the multi-level direct selling company selling jewelry products failed to respond to DSSRC’s inquiry.

At issue in DSSRC’s inquiry are earnings claims disseminated by salesforce members on social media implying that participating in the company’s business opportunity will result in earning significant, career-level income.

The earnings claims in question were brought to the company’s attention by DSSRC as part of its ongoing independent monitoring of the direct selling marketplace. The Fifth Avenue Collection earnings claims in question include, but are not limited to:

 

  • Need extra 💲; Need a first income?; Need a second income?”
  • “Whether you want a little extra mad money 💰 or a full-time income, the opportunities are endless!”
  • “What would you do with an extra $200, $600, or $800/month? Or even more! 💎Ask me how you can earn a great income with Fifth Avenue Collection😊

DSSRC expressed its concern that such earnings claims convey the message that participants in the company’s business opportunity can generally expect to earn significant and career-level income.

The company was first sent a Notice of Inquiry from DSSRC in June 2022, to which the company did not respond. After several additional attempts to contact various individuals at the company, the company failed to respond to DSSRC’s inquiry and provide substantiation for the claims.

In accordance with DSSRC’s Policies and Procedures, if a company does not respond to DSSRC or declines to participate, DSSRC will issue a case decision indicating the company was unresponsive or declined to participate in the DSSRC process and refer the matter to the appropriate government agency. Moreover, according to section (V)(B) of the DSSRC Policies and Procedures, if the subject company fails to submit a responsive statement, DSSRC may refer the matter to an appropriate government agency for review and possible law enforcement action. Accordingly, based upon the company’s failure to respond to DSSRC in the self-regulatory process, DSSRC referred this matter to the FTC.

BEEAH Group and Green Planet join forces in landmark 10-year contract to advance sustainable waste management in Egypt’s Sharm el-Sheikh

Driving Egypt’s sustainability agenda in the key area of waste management, BEEAH Group, the Middle East’s sustainability pioneer, and Green Planet, Egypt’s emerging environmental services company, have formed a partnership to deliver a landmark ten-year contract in Sharm el-Sheikh. The development comes ahead of Cop27, which will be held in the city between November 6 and 18, 2022. Recycling of used cooking oil is one of the specialised waste collection services that BEEAH Group and Green Planet will offer. This will help minimise the burden on public plumbing infrastructure that arises from used cooking oil disposal through pipes and drains, while also enabling the production of alternative green fuels. As per the contract, BEEAH Group and Green Planet will deploy used cooking oil deposit machines in strategic locations throughout the city. Then, thousands of special used cooking oil collection bottles will be distributed among residents. Once a bottle is full, individuals can deposit it into the used cooking oil machine. As soon as a deposit is made, the machine will dispense an empty collection bottle, encouraging users to continue collecting and recycling used cooking oil.

 

The contract with Sharm el-Sheikh is the BEEAH Group’s second in Egypt. In 2020, BEEAH Group signed the Middle East’s largest waste management contract with the New Administrative Capital, one of the largest urban development projects in the world, which targets an ambitious landfill waste diversion rate of 80%. The new contract adds to BEEAH Group’s efforts to consolidate its position in Egypt and across the region, following its success in the UAE as a sustainability pioneer.

 

Driven by Egypt’s Vision 2030 and Vision 2050, Green Planet was founded specifically to develop the solid waste treatment business in Greater Cairo and pursue innovations in waste processing and production of low-emission alternative fuels. Currently, it is exploring innovations in processing municipal solid waste and hazardous waste such as electronic waste.

Urban Story Ventures’ Leasing Plays Major Role in Chattanooga’s Strong Commercial Real Estate Market

CHATTANOOGA, Tenn. (August 23, 2022) – Urban Story Ventures (USV) continues to overcome national market odds with laser focus on Chattanooga’s commercial real estate needs. While the majority of the country’s commercial real estate market suffered from pandemic challenges, Chattanooga emerged as an exception, among cities like Miami, Austin, and Boise. With Chattanooga ranking as a top 10 commercial office market in 2021 and vacancy rates consistently hovering at 4%, demand is high. In response, USV is working to address the community’s current and future real estate needs.

Over the last 18 months, USV has experienced record-high lease transactions. Together, JP Evans and Megan Freeman worked in-house to lease over 270,000 square feet of space for more than 55 commercial tenants in the Chattanooga market. Spaces ranged from 140 square feet to over 28,000. Despite pandemic challenges, JP Evans, director of leasing for USV, leased nearly all of the remaining vacant offices in the 477,000-square-foot Midtown Office Park, leading USV to a 95% office park occupancy rate. This success helped position the sale of the single-level office park buildings to Greenleaf Capital earlier this year. USV has helped recruit major high-profile state and federal tenants to its properties. In fact, the City of Chattanooga has relocated a number of offices to the Midtown Office Park and occupies over 20,000 square feet.

CapStar Bank is one of USV’s newest tenants to choose Chattanooga for its next venture, as the city continues to be a hot spot for company expansions. Based in Nashville, CapStar’s more than 20 locations stretch from Middle Tennessee to Knoxville. CapStar is moving into the James Building downtown.

“Chattanooga’s demographically-diverse and innovative focus is a strategic fit for CapStar’s mission of investing in local markets, developing core banking relationships, and delivering a differentiated service experience,” said Brian Paris, CapStar’s Chattanooga market president. “We believe our investment in top talent, in addition to our forthcoming marque location, will position us to capitalize on the tremendous opportunity in Chattanooga.”

Lipman Brothers is another new tenant on USV’s roster. Founded in 1939, the wine and spirits distributor services 74 of Tennessee’s 95 counties and recently leased over 7,000 square feet of space at the Midtown Office Park.

“This move will increase the time we are able to service Chattanooga,” said Tony Giannasi, southeast regional manager for Lipman. “With recent acquisitions of Ranch Water, North Berkeley Imports, and Athletic Brewing Co, we are primed for the next chapter of growth.”

Lipman holds Tennessee Permit No. 1 for the distribution of beverage alcohol and employs more than 400 persons throughout the state.

USV is looking to develop more space to accommodate the increasing demand.

“Right now, there aren’t enough places to put everyone. We have a lot of interest, and our Chattanooga portfolio is almost at full capacity,” said Evans.

One prime example is 1111 West Main. USV is already recruiting and signing new tenants for the mixed-use building, which will be the first of many 10-plus story buildings at the Bend. The Bend, a 120-acre adaptive reuse development along the Tennessee River, will address needs from commercial to retail to residential. Jimmy White, the company’s president and general partner, says the tenant recruitment approach is two-fold.

“We have great existing community demand, and we’re also working with state and regional partners to welcome company expansions and headquarter relocations for businesses that see the glistening benefits of operating here. With economic incentives, no state income tax, and a city leading the way in outdoor recreation, tech, and transportation and logistics, Chattanooga is one of the most attractive cities to set up shop in America.”

To date, hundreds of millions of dollars have already been invested at the Bend, including millions of USV’s direct investments, and the site is home to more than 800 jobs after housing just three jobs a few years ago.

“By the project’s completion, we anticipate having 7.3 million new square feet of space, supporting over 17,000 jobs, and seeing more than $4 billion invested at the Bend and in our community,” said White.
